Texas Law Changes THC Rules Making Some Previously Legal Hemp Products Illegal

By Jeff Easterling on August 12, 2026 City News, Crime, Crime Stoppers

A change in Texas law that took effect July 31 has altered the legal status of several hemp-derived THC products, and the Texarkana Texas Police Department is reminding residents that products they may have legally purchased before the change could now be illegal.

Police emphasized that the department is not weighing in on the debate surrounding the law, but said the goal of its public notice is to make sure residents understand the change and avoid unintentionally running afoul of the law.

Under the new rules, several hemp-derived products containing intoxicating THC isomers or analogs are now classified as Schedule I controlled substances in Texas.

Those products include Delta-8 THC, Delta-10 THC, THCP and other THC isomers or analogs covered by the law.

That means a product that was legally purchased in Texas before July 31 is not necessarily legal to possess today.

However, the law does not make every hemp-derived product illegal.

Certain hemp products that meet Texas requirements remain legal, including some products containing no more than 0.3% Delta-9 THC by dry weight, among other requirements.

The police department offered a simple way for residents to remember the basic distinction:

    “If it’s 9, it’s fine.”

Police cautioned, however, that the phrase is only a general reminder and does not cover every detail of the new law. The legality of an individual product depends on its contents and whether it meets all applicable Texas requirements.

The department is encouraging residents who have hemp-derived THC products at home to check what those products contain rather than assuming they remain legal simply because they were purchased legally before the law changed.

The change took effect July 31, 2026.

The department said its message is intended to provide information rather than enter the debate over Texas’ THC policy.

The bottom line for consumers: The law has changed, and legality now depends on what’s actually in the product.

Before possessing or using a hemp-derived THC product, residents should make sure they understand the current Texas requirements.

This story is based on information provided by the Texarkana Texas Police Department. It is not legal advice.
